Opponents of the Revolution Whose Pennsylvania Estates Were Confiscated ANNE M. OUSTERHOUT, Ph.D. ODAY THE RIGHT to dissent is recognized by most Americans, .I. but during the Revolution this was not the case. To oppose the prevailing opinion about the separation of the colonies from Great Britain was to invite retaliation that varied from ridicule to execution, depending on how that opposition was expressed. Among the punishments suffered by some dissenters was property loss which could occur through theft or destruction by mobs or through confiscation by the state. Arguing that to leave the state was a form of treason, Pennsylvania confiscated the real estate of some one hundred and twenty-one citizens who fled behind the British lines, even though it was never determined in a court that most of them had taken any action to help the British or hurt the state. The state confiscated all but three of these one hundred and twenty-one estates by means of bills of attainder. Beginning in May 1778, the Pennsylvania government passed a series of proclamations listing the names of individuals believed to be with the enemy. These persons were given a limited period during which they were to report to a Pennsylvania judge for trial for treason. If they did not report before the deadline, they were simply declared guilty of treason which was punishable by loss of all their property and, if caught, by death. Once a man's name had appeared on a proclamation, the local sheriff visited his home and inventoried all his possessions. When the deadline passed without the named person reporting, the sheriff returned with a cart and helpers and took away all the personal possessions to a public sale. At the same time, the accused's real estate was also confiscated, and later sold. The judge's only function was to confirm their identification, their inclusion in a proclamation, and their failure to report on time. The punishment was set by law, and the judge had no alternative but to sentence them to be hanged. Fortunately, this unjust procedure led to execution only twice. It was used more frequently, however, to take property of those opponents of the Revolution who left the state. Eleven proclamations were issued by the Pennsylvania government between 18 May 1778 and 27 April 1781, containing five hundred names. Because of duplication and errors, this probably represented about four hundred and ninety persons. Of these, one hundred and thirteen are known to have reported on time, of whom only two were tried, convicted, executed, and their property confiscated. Of the remaining three hundred and seventy-seven, one hundred and eighteen suffered attainder by proclamation and lost all their property, both real and personal. One man, George Harding, whose name did not appear on a proclamation was also accused of treason, tried, convicted, and suffered attainder. Although he was subsequently pardoned as to his person on condition that he leave the state, his real estate was still confiscated. At least twenty-six more attainted persons lost personal property, but apparently owned no real estate to be confiscated. Beginning in the summer of 1779 and continuing for many years, the confiscated real estate was sold by the state at auction to the highest bidder, with proceeds from the sales going to the state. The money raised was used not only to pay the operating expenses of the state, thus reducing taxes, but also to establish an endowment for the state university and to help Pennsylvania soldiers conteract inflation. The university was helped in two ways. First, ownership of fortyfive estates was assigned outright to that institution for its use. Another group of estates was sold to private buyers on condition that one-fourth of the purchase price was to be reserved by the buyers and paid to the trustees of the university over a period of fifteen years with interest. In order to help Pennsylvania's soldiers whose salaries were paid in constantly depreciating continental money, the state legislature in December, 1780, passed an act giving the soldiers certificates good for the purchase of confiscated property. Special commissioners calculated the value in specie of all continental money that each soldier had received in pay. Then the difference between that value and the The Pennsylvania Genealogical Magazine 239 declared pay of the soldiers was given to each man in "depreciation certificates." These certificates could be used to pay for the purchase of auctioned confiscated estates. Evidence indicates, however, that most of these certificates may have been sold for much less than their face value to speculators. The table' on page 240 lists the one hundred and twenty-one persons whose real estate was confiscated by Pennsylvania during the Revolution. It describes the property confiscated, the date sold, the price paid, the name of the purchaser, and any information known about the buyer. Many of these people who left Pennsylvania ultimately went to Canada to start a new life. As part of the first large influx of English. men to that area, they have been regarded by English Canadians as founding fathers. Thus American traitors became Canada's heroes.
