Genealogical Gleanings From Orphans Court Records of Lancaster County, Pennsylvania Abstracted by SOPHIE SELDEN ROGERS A LTHOUGH Mrs. Rogers made the following abstracts more than twenty-five years ago, they were never incorporated in her extensive collection of genealogical material now included in the Collections of the Genealogical Society of Pennsylvania. Apparently she had intended her original typescript, from which the following copy has been taken, to be bound separately and placed in the Lancaster County section of the Society's Collections. The original typescript she had compared with either the recorded entries in the original books, or with her initial notes, for it includes various corrections made in ink. These have been incorporated in the present transcript. Since she made the abstracts solely for the purpose of obtaining family relationships, the researcher is advised to consult the original records in the Lancaster County Court House, Lancaster, Penna., for the complete individual record, not all of which was abstracted by Mrs. Rogers. The Editor assumes no responsibility for the accuracy of the present abstracts. The bill for erecting "the Upper Parts of the Province of Pennsylvania, lying towards Susquehanna, Conestogoe, Dunnegal, etc.," into a new county to be called Lancaster County, out of the original Chester County, was signed by the Lieutenant Governor, Patrick Gordon, 10 May 1729.' John Wright, Tobias Hendricks, Samuel Blunston, Andrew Cornish, Thomas Edwards, Caleb Peirce, Thomas Reid and Samuel Jones were nominated in the bill for Justices of the Peace, any three of whom were empowered to sit as judges of the several courts, including the Orphans Court. Suits and actions, commenced or depending in Valdes at Large 01 Pennsylvania from 1682 to 1801 (1597), IV, 131, Chapter CCCVI, An Act for Erecting the Upper Parts of the Province of Pennsylvania . . . ono a County." for also "Vous and Proceedings of the House of Representatives of the Province of Pennsylvania," Pennsylvania Archives, sth Series, In, (1931), 1957'1963. The Pennsylvania Genealogical Magazine 16 the County of Chester, against inhabitants of the newly erected Lancaster County, were to be brought to issue in Chester County.' In 1733, when Thomas Penn, the Proprietor, produced a new Great Seal for the use of the Province, new commissions were issued under it to the same persons with the exception of Andrew Cornish, and with the addition of Edward Smout and Derick Updegraf.' Four years later in January 1736/7, new commissions were again issued for Lancaster County justices, "some of those named in the last one being dead, others removed, and several parts of the County being entirely unprovided." The new commissions renamed John Wright, Tobias Hendricks, Samuel Blunston, Thomas Edwards, Samuel Jones, Edward Smout, Derick Updegraf, and added Andrew Galbraith, Mark Evans, John Caldwell, James Whitehill and Emanuel Carpenter.' By 1742, when the volume, abstracts from which have been transcribed hereinafter, was begun, Thomas Edwards, Samuel Jones, Andrew Galbraith, Edward Smout, Samuel Smith of "Conai," Emanuel Carpenter, Thomas Cookson, John Kyle, James Armstrong, Samuel Smith of "Coniwaga," Samuel Boyd, Andrew Douglas, Richard O'Caihan, John Hogg, Conrad Weiser, John Reynolds, James Whitehill of Salisbury, James Lewis of Tulpehocken and David Jones of Pequea were the Lancaster Justices of the Peace, and presumably sat as justices of the Orphans Court.' Though this court technically had been sitting for over a dozen years, its earliest determinations do not appear to be extant. If they were recorded, it is possible such were lost, or destroyed by the fire in 1784 which demolished the first court house built in Lancaster. The volume presented hereinafter is labelled "Orphans Court Book 1742 - 1760," but Mrs. Rogers apparently transcribed only the first 100 pages, extending into 1758. According to Mrs. Rogers' labelling, it is Volume I, consisting of three parts, the first part of which is now presented. Parts 2 and 3 will be published in forthcoming issues of the Magazine. "Coati" or Conoy, where one of the two Sanavel Smiths lived, it in the extreme northwestern cornet of the present Lancaster County; its northern boundary is the Conewago Creek which divides Dauphin County from Lancaster County. Account of George Hood, Administrator of estate of ADAM HOVER, 6 deceased, shows balance belonging to Jacob Hover and Mary Hover, minor and orphan children of Adam Hover. It is Ordered that Jacob Hagey be guardian over said minors. COURT held at Lancaster June 1, 1742. Before Edward Smout, Emanuel Carpenter, David Jones and Samuel Boyd, Esquires, Justices. Application of Lodowick Reigert of Albany in the Government of New York, praying that the share of the Estate of JOHN FISHER,' late of Lancaster, bequeathing by Will to his son, John Fishes, Jura, now living in Albany may be paid to Lodwick Reigert, as empowered by a certain Letter of Attorney under the Hand and Seal of John Fisher, Junr, Certified by John Lawyer and John Schelfer, Justices of New York. Petition of Roger Hunt admimstrator of ROGER HUNT, stated said intestate dyed seized of House and Lot in Borough of Lancaster and prayed permission to sell same f or payment of debts. All administrations in Lancaster County prior to 1821 are filed with the bond lathe office of the Register of Wills, Lancaster County Court House, Lancaster, Pa. The Index to the Will Books and Intestate Records of Lancaster County, Pennsylvania, 1729-1850 (1936), prepared by Eleanore J. Fulton and Barbara Kersdig Mylin, gives no book or page number or docket reference for the early administrations, only the year fded. Thus the original letters of administration should be consulted to find the complete date of filing and to whom letters were granted. Where there is CIO annotation for a decedent mentioned in the abstracts given in the present teat, the presumption is that the decedent died intestate. John Fisher's will, proved 23 Feb. 1739 [/40], was written in German and not manslamd or abstracted in the Abstracts of Lancaster County Wills in the Collections of the Genealogical Society (GOP). It was entered in the above noted Index as being recorded in Lancaster Co. Will Book A-1, 451739. The reader should keep in mind that until September 1752, the legal year in Pennsylvania began on 21 March, although the historical year began 5 January. Dates between 1 January and 24 March are therefore double-dated, vim I Jmuary 1739/40 and 24 March 1739/40, but 25 March 1740. It was Ordered that Samuel Jones, Esqr, Andrew Moor and Samuel Williams or any two of them Set a reasonable yearly value of the plantation and Lands of JAMES CLEMSON,. deceased. They report the plantation is worth fifteen pounds Pr year. ORPHANS COURT held at Lancaster the tenth day of February 1743. Before Edward Smout, Emanuel Carpenter and Conrad Weiser, Esqrs. Justices. Petition of Mary Bethel and Samuel Bethel, Minor Children of SAMUEL BETHEL late of Lancaster, by Samuel Blunston and Benjamin Davis, their next Friends. Setting forth that their Father about three years ago dyed intestate leaving a considerable Estate. The Petitioners being under age pray that a Guardian may be appointed. It was Ordered that Samuel Blunston of Hempfield Township, Gentleman, be appointed their Guardian. John Morris and Margaret his Wife (which said Margaret was Widow and Administratrix of DERICK UPDEGRAEF, 9 late of Lancaster, deceased) That the Deceased left a Widow and six children (to wit) Herman, Mary (now Wife of Peter Bangot), Joseph, Ambrose, Jacob and Susanna. On Application of Friends, John Myer is appointed Guardian over Joseph, Ambrose, Jacob and Susanna. ORPHANS COURT held at Lancaster the twenty seventh of March 1744. Before Thomas Edwards, Edward Smout, James Whithill & a/. Esqrs. Justices. Application of William Kikreese, Samuel Scot, Executor of WILLIAM SCOT, 1° being Cited to Appear and give an Account of his Executorship, produced a Copy of the Inventory. It is Ordered That Anthony Dilworth and Hugh Patrick make a Just and reasonable Appraisement. [5] Upon settling the Account of Mary Clemson, Administratrix, it appears there is a Ballance payable to the Widow, James, eldest Son, Sarah and Rebecca Clemson. It is Ordered that Samuel Williams and Andrew Moor are to be Guardians over said children. It appears by receipts that James has received his full share, also that John Hoins and Sarah his Wife have received their share. Jam. Clemson, for whom no bond or letters of administration are of record, was a son of James Clemson, blacksmith of Chichester and Concord Twps., Chesmr Co., and of Philadelphia where his will is filed. See Philadelphia Will Book D, 98, #1271718. The son James Clemson is said to have died in 1741, and to have been a minister among Friends at Sadsbury Monthly Meeting. See letter of J. Clemmn Sharplas, dated 18 12m 1892, in the Gilbert Cope Collection, GSP. This younger James Clemson settled on 200 acres in Salisbury Twp., part of 636 acres in Lancaster Co. which his father James Clemson had been granted by patent dated 18 May 1716. Lancaster Deed Book H, 383: 26 March 1731, John Clemson et el. to James Clemson. According to an abstract made by the Editor, this entry in the present text was part of the record of the .settlement of the estate of the son James Clemson. Of the balance of £227 available for distribution, the widow was to receive £75 135. 4d., his son Janes Clemson a similar amount, and his daughters Sarah and Rachel each £37 19s. Ild. 8 If a bond was Sled by Margaret, the widow and edm,nistratria of Derick Updegraef, it was not included in the Index coed in Note 6. Letters of adminioration, however, are said to have been granted on his estam 19 June 1739 at Lancaster. According to the researches of Clyde Updegraff Shank, Derick Undegrad was the son of Isaac and Maria Updegraff of Skippack, and the grandson of Abraham and Catherine, or Trintje, Updegraff, the emigrants. Unfortunately Mr. Shank presents no proof of such a relationship. The will of William Scott of Drumore Twp., dated 8 Oct. 1739 and proved 7 May 1743, named his wife Martha and children Elizabeth, Mary, Margaret and Samuel Sc,ott. Will Book A-1, 781743. The Abstracts of Lancaster County Will Books, GSP, from which the present annotations are taken, are arranged alphabetically and chronologicaltY, and include no information except . 0" and dates. Genealogical Gleanings 19 Petition of Samuel Graff, Administrator of JACOB GRAY praying an Order to sell some of the Real Estate to satisfy the debts and for maintaining the children. Request granted. [6] ORPHANS COURT held at Lancaster the fourth day of May 1744. Before Thomas Edwards, James Whitehill, David Jones and Andrew Galbraith, Esqrs. Eleanor Hollebach (late Stout, Widow) Administratrix of CHARLES STOUT, now Wife of John Hollebach, praying that Guardians may be appointed for Peter Stout, three years of age, and Eleanor Stout, six years of age. Peter Stout and Robert Jones are appointed Guardians over the said Peter and Eleanor. Upon settling the Account of Frierre and Wiley on the Estate of [Thomas] WYLIE, it appears there is a Balance to be distributed to Wm. Wyley, Margaret (Wife of James Bell), Sarah (Wife of John Maxwell), Their shares to remain in the Hands of the Administrators. That John Wyley receive his share, John McCallister (he being a son of Agnes who was marryed to Joseph McCallister who are both dead) to be put out to Interest, and the Uncle is to Inquire into the Circumstances of the Child. Wm. Wyley lives in Acheydaray in the County of Down. Margaret Marryed to James Bell in the same County. Sarah Marryed to John Maxwell in the same. Benjamin Chambers is appointed guardian over Thomas, James, Mary and Jane Chambers, Orphan children of JOSEPH CHAMBERS,. deceased. Gabriel Davis, Alexander Wilson, William Wilson, Robert Patrick and George Hudson appointed to appraise Lands of JOHN ANDERSON and make report at next Court. [10] Upon Settling the Account of the Estate of MARTIN WEIDTMAN it appears there is a Balance to be Distributed to the Widow Catherine, (intermarryed to John Lane), Martin Weidtman eldest Son, John, Mathias a minor, and Elizabeth, wife of Adam Housealder. It appears by Receipts produced by Joseph Hopacre that one hundred pounds thereof was paid to Susanna Ewing in her Widowhood and John Connelly her present Husband, since Exhibiting the Inventory. And the said Susanna appearing and relinquishing her Guardianship over the Estate of her Children, Gordon Howard, Jas. Wright and Samuel Blunston are appointed Guardians. Petition of John Taylor Setting forth that his late Father JOHN TAYLOR dyed Intestate leaving two hundred and two acres in the Township of Hempfield, in County of Lancaster and issue, the Petitioner his only son, and four daughters (viol.) Barbara, (now Wife of Joseph Brown), Fronika, Elizabeth and Mary Taylor, and Fronika his The will of James Patterson of HempEeld Twp., dated 3 Oct. and proved 11 Nov. 1735, named his wife Susanna Howard) executrix, and children James, Thomas, Sarah, Susanna and Rebecca Patterson. Possibly the Joseph Chambers who is said to have emigrated from Coumy Antrirn, Inland, between 1726 and 1730, with James, Robert and Benjamin Chambers. He appears to have been confused with share Joseph Chambers who in 1748 returned to what is now Dauphin Co. from a sojourn near Chambersburg, now Franklin Co. The earlier Joseph Chambers was perhaps he who obtained a wartmt for 100 acres 3 Aug. 1743, and 258 acres 12 Nov. 1744. Pennsylvania Archives, 3rd Series, XXIV, 381. 382. Genealogical Gleanings 21 Widow and Administratrix who has since intermarried with Peter Coot. The Petitioner's Mother and sisters being desirous that partition be made among them. It is Ordered that Henry Neulf, John Brubaker, Jacob Brubaker and Chnstian Stoneman should value said plantation. They now report that the plantation is valued at four hundred and seventy seven pounds. And it being now Certified to the Court under the hands of the said Joseph Brown and Barbara his wife, Peter Coot and Fronika his wife, Daniel Essleman, Guardian of said Fronika Taylor, Ulrich Root, Guardian of said Elizabeth, and Henry Bare, guardian of the said Mary. Peter Pixacre and Peter Blazer are Appointed Guardians over Anna Christena Pixacre and Maudlin Pixacre, Orphan Children of JOHANNES PIXACRE, deceased. Upon the Application of John Hare and Emanuel Hare, two of the Sons of EMANUEL HARE, deceased, on behalf of themselves and the other children of the said Emanuel, that the Estate may be appraised and Guardians appointed for Martin and Elizabeth Hare, both being Minors. It is appointed that Martin Myley, Junr, Henry Shank, Henry Kindig, Daniel Fieree, Junr, Daniel Carpenter and Michael Grove do appraise said Estate. And it is further Ordered that John Hare, Junr, and Christian Hare are appointed Guardians over Martin and Mary Hare. At the same Court Martin Myleys Daniel Fieree, Michael Grove and Daniel Carpenter report they have appraised Estate of Emanuel Hare at Twelve hundred pounds. Upon Application of Margaret Maganet, Administratrix of SAMUEL MAGANET who Dyed Intestate seized of a Dwelling House situated in King Street in the Borough of Lancaster, and praying an Order for Sale of the said House to enable the payment of Debts. The said Lot of Ground and Dwelling House was sold to Bernard Vanleer. ORPHANS COURT held at Lancaster the sixteenth day of October 1745. William Miller is appointed Guardian over Katherine Hale, an Infant Daughter of JAMES HALE, deceased. It is Agreed by the Heirs of the said James Hale that ten pounds should be allowed f or the Maintenance of Catheime, and twenty pounds for the maintenance and Schooling of Alexander and John Huston Viz!. Upon Application of Anthony Weyrick, the nearest Relation of Sebastian Monk, an Orphan Child of PHILIP MONK, deceased, to have a Guardian appointed over the said Sebastian.
